Short description:

The GVH launched its investigation against the undertakings because of the stipulations of their model contracts on programme distribution. On one hand the GVH established that the model contracts were of restrictive nature on the signing distributor parties, while on the other hand the GVH also established that the contractual practice in its purpose to limit competition also affected the non-signing distributors.

Decision:

The Competition Council established that the undertakings had violated both Article 11 of the Hungarian Competition Act and Article 101 (1) point a) of the TFEU and as a consequence obliged the Hungarian Cable Communications Association to pay the fine of 8 million HUF (27 thousand EUR), while the Hungarian Cable Television and Telecommunication Association was obliged to pay the fine of 3 million HUF (10 thousand EUR).
