Decision of the Competition Council of the Hungarian Competition Authority (Gazdasági Versenyhivatal - GVH) Vj-202/2005: UPC

The Competition Council of the Hungarian Competition Authority (Gazdasági Versenyhivatal - GVH) established in its decision, issued on 24 April 2006, that UPC, an undertaking active on the telecommunications market, infringed the provisions on the prohibition of unfair manipulation of consumer choice of the Hungarian Competition Act.

In the competition supervision proceeding the Competition Council of the GVH concluded that certain advertisements of UPC, which stated that certain services of UPC were free of charge, were unlawful. The reason for this was that, contrary to the statements of UPC, the consumers were always charged a montly fee, therefore the service could not be held to be entirely free.
The Competition Council imposed a fine of HUF 10 million (approx. EUR 40000) on UPC for its unlawful behaviour.
